Far out! . You're lucky to have all of your limbs intact, let alone be alive! Fortunately it looks like the brunt of the impact was taken on the passenger's side. Sorry to see that, but good to hear that you walked away from it. How did it happen anyway? Were you going too fast for the corner? Are you insured?

Good God...you are one lucky guy! Also its good you guys have drivers side the "wrong" side ;-) Otherwise you would be reading this TN post from your hospital bed.
How did that happen though? Getting a new car?

You can buff that out.

Long story man, I’ll summarise

Driving at night to my parents house just after washing my car...sitting on a road where the speed limit is 100kms, a 4WD+horse float sitting on 70km/s I decide to overtake, pull into the right hand lane (yes us aussies drive on the left) punch it to get up to 100km/s when the fu**er decides he’s turning right, just as I get along side his trailer he pulls out to the right and I ploughed into the front of his car, bounced off him and hit a power pole, head on, whilst spinning and took out a few street signs and a guys fence.

Now one would think, why were you overtaking? The as*holes indicators didn’t work on his trailer, so I had no way of knowing he was turning, however my insurance and the F*n cops said it was my fault...! So the argument began... I said I would have been over taking if his indicators were working but the cops say you were overtaking a turning vehicle, again...i WOULDNT HAVE BEEN OVERTAKING IF HIS INDICATORS WERE WORKING!

So I had to pay a $275 traffic infringement, $475 for the tow truck $900 for the insurance excess $ 180 for the doctors bill and my insurance pays about $50,000 worth of damage to the other party and properties

I was insured but only 3rd party (meaning my insurance only covers all OTHER damage except my car)

So worst of all, I have NO CAR

That's bloody awful. I would seriously consider pursuing things legally, the person in the truck was driving with non-working equipment which directly caused an accident. Sorry about your car, but you walked away, things could have been far, far worse.

APPARENTLYin aus)
his car was 'un roadworthy' meaning its a vic-road matter, not a law
i was breaking a law, the two dont mediate....

But contradiction is.
A police officer will fine you for having a un-roadworthy vehicle (this pig didn't)

Not much i can do about it now (this happed a few months ago), however i think i will be getting another Camry, the interior was almost perfect after the collision!

Dude, that sucks! The other vehicle shouldn't have even been on the road! Over here that would make them instantly liable. I'd go and see a public lawyer if I were you (the free ones) to get some advice. As long as you weren't overtaking on double yellow lines then you shouldn't be held liable. Your laws are probably a lot different than over here, but it's worth a shot.

I personally would do this, just so I could say hey, I tried. And honestly it doesn't really matter what the cop decided, often times they will just do whatever is easiest for them, not what is necessarily best or right (I know this first hand).

Everyone is different, but honestly if it was me, I would sue the driver for damages to my car at minimum. And as soon as you did that, his insurance would get involved because they would be the one footing the bill if you won, so they may just choose to settle with you instead of dragging things out in court. It's worth a shot IMO, but then again some people just want to put things like this behind them, I understand that.

But there is no way in hell anyone should be found at fault if the other person was driving an unsafe vehicle. That would be like someone driving with no headlights, you hit them, but you get blamed because you were passing someone or making a turn across traffic or something to that effect. That cop was not thinking clearly or was just being a dick.

Pretty brutal stop there! Good to see this old cars hold up well and you walked away!

I see it did buckle the roof line a little, but the cabin held up well.
Question, did the air bag deploy? And you had your seat belt on so other than minor aches and pains in the days after the crash a 50 to 60mph (90 to 85k/h) impact was survivable.

I'm think smaller cars wouldn't have done as well and/or if they hold up, then its harder on you. . .

Crazy law saying what you toe is OK even if its not lit and blocks the towing vehicle.

Glad you're OK!

Holy. First, I'm glad you were able to walk away from the accident - your Camry did what it was supposed to and sacrificed itself so you stayed safe. I'm really impressed with how well it held up. Your windshield isn't even shattered!

I think the situation is pretty messed up though. OBVIOUSLY you wouldn't be overtaking another vehicle if you could clearly see it was signaling. It would be your fault if you just weren't paying attention but they weren't operable on his trailer!

I hope you find another Camry.. Best of luck!
