I am guessing that the author of this thread hit something or damaged the car somehow and caused a transmission fluid leak. That person continued to drive until the transmission was wrecked. Toyota wouldn't cover it in that case because it's not a defect.

I've seen that many times.

Just because the car is under warranty doesn't mean that if something is wrong you can drive it into the ground and expect someone else to pay for it.

We'll probably never actually get the true facts regarding this situation.

EDIT: If that is the case and the dealer warranties it the dealer will get charged back. Toyota will gladly pay the dealer to repair any defects under warranty. Toyota will also be more than happy to make the dealer pay for repairs that aren't actually warranty.

Obviously the dealer doesnt care about that, basically it sounds like dealer is all about "go away and dont bother me."
The only "evidence" the dealer has is that there was supposed to be tire rubber under the body which they are saying was from doing burnouts or some sh^t. Unless the dealer has a chemist on staff, how can he tell that it is tire rubber and not asphalt from the road or some combination therof...the answer is, he CAN'T tell what it is.
And if there were physical damage to the trans like hitting something, there'd be broken castings or a dented pan to show it. And he would have mentioned it in his post. POS, lazy dealer is what it sounds like to me! He oughta name this dealership so everybody can make a point never to go there and he goes out of business from being a selfish, stupid ass.

call the state attorney general and file a complaint. also contact the better business burearu, and the city or town consumer protection division.. let them know you will file these complaints if they do not replace it. that car is new, they have to fix it. no charge to you. you will then see them change their tune and help you. like was mentioned here, even if you press it to the pedal that does not void your warrenty. but what evidence did they present to substantiate that you were racing? rubber? never heard of that one before.

that won't make a tranny leak..... there's a soft rev limiter that will cut fuel anyhow. read my post from pages before..... the story is not 100% told from the original author. need all the facts... so i wouldn't call foul on the dealer and Toyota yet.

like i said before... he needs to focus on how the leak occured.
