The leak is probably a bad weatherstrip or window run. You will have to find exactly where the air is leaking and repair or replace that specific area.
The window that's stuck could have a faulty regulator or track/guide. You will have to go into the door and find the problem.
the leak is the top right cornor of the window, i was also told that the alignment might be off

It's possible but very unlikely. Is it? You should be able to see if that's the case when you roll the window up. If it's not out of adjustment you will need a new run channel.
well i was told by the guy who did my tints that as the window goes up it shifts

Maybe it does.
Does it? Look and see. It doesn't matter if someone says that and it's not true. It only matters if it's true. Slowly roll the window up and watch to see if it shifts...

It's also possible that the window could be dragging on the run channel. Does it shift back into position when you roll it down? Does it go into position when it reaches to top of the channel?
A better description of what exactly happens and at what points would help greatly.
it shifts what looks like back into place when i put it up all the way

Sounds like the tracks are worn. I'd remove the interior panel, loosen the glass from the lowering mechanism, and slide it up and down slowly by hand so I could feel at what point it goes in and out of proper alignment. You should be able to work it up and down until you find an exact spot and then take a look at that track and see why it is behaving the way it is.

yes this is TRUE, same problem on mine, window rolls up then shifts towards the front of the car slightly (few mm's). Had to get it retinted twice. It's a toyota thing apparently.
I even get the odd wind noise here and there, easy fix... just quickly tap the power window button down and the window will ever so slightly dislodge from its shifted position into a more sealed position. works every time and happens to me very rarely, once a month or so.
