I bought my car on April 24, 2007 and in May of 2007 the transmission was replaced due to the infamous flare, then the car was fine and seemed that everything was fine.
But to be real, it can't be that easy right?
Well the flares came back 2 months ago and I didn't care because it was only a 200-300 rpm flare, but today in middle of traffic it flared again but this time it wasn't 200-300 rpms it was actually close to 1,500 rpms, almost rear-ended somebody.
So I got pissed like usual and took it straight to the dealership. They greeted me like usual because I am in there so often but this time I put on the serious/pissed face before walking in, so they knew I meant business. They gave me an appointment for tomorrow, but I insisted that it occurs worse at cold starts so they took it in today.
My car has already been in the dealer for close to 15 days prior to this service and after this it will most likely be close to 20 days. That would mean that it would have to be in there for 10 more days in order to be considered a LEMON.
I also had a question, once they consider a car a lemon what do they do? Do they give you a new car or do they refund you what you've paid?

They gave me the "there is nothing wrong with it" BS, today and I know it is still happening... there is also two rattles in the roof and passenger side seat. This car is a piece. LOL I don't know they said it was ready but I am going to take a service manager on a ride in the car because I know I can make it happen.

For kicks, I wrote a letter to the President of Toyota. A week later, I received a call from a "representative" regarding the same. She was a complete b*tch! She was very confrontational. I simply asked in the letter when Toyota anticipated a complete resolution to the transmission problem. Additionally, I said that I was not willing to have the local dealer experiment on my car with fixes that don't work. She responded, "how do you know they don't work, you haven't even brought your car in." Of course I told her that my conclusion was based on eveyone else's experiences. Then she said, "do you know that if your car is in the shop for 24 hours, the dealership is 'required' to provide you a loaner." Who cares! I don't want a loaner, I just wanted to know when Toyota was going to have a permanent fix! She ultimately asked if I wanted my "case number" to which I responded "for what?!?!" Case number? I just wanted an answer to a simple question...wtf! Then she hung up on me. I doubt I'll buy another Toyota after this one. That is the kind of service one would expect from a minimum-wage employee at the drive-thru at McDonalds.
I thought the flare happens when it is shifting, meaning the gear disengages, engine revs up, then shifts to next gear... i dunno
does everyone's car jerk forward when the flare happens?
Nope, for me it just revs in between shifts and the only thing I notice is that the car DOESN'T move, because it's held out of gear longer. I've had it happen to me in traffic as well, usually when I've been in first and second gear for a while with slow moving traffic, then when I increase to 35-40mph it does it between 3rd and 4th.
If you are going to attempt to return the car under the Lemon Law suggest you do some research first. Might read “Return to Sender” by Nancy Barron. The book covers getting a refund or replacement under the Lemon Law.
The manufacturer and dealer are not going to let you return the car willingly, expect some hardball tactics. If you are serious consult with an attorney before proceeding.

Ya I have an attorney and he said the odds are on my side. I just need one more visit to the dealer. I am gonna make them go crazy!!! hahaha

Ya but I need three different incidents so today i did the roof incident and in a few days I'll go back for the transmission. AGAIN
Lemon Laws vary by state, but in our state you need to have the car at the shop for 6 times (they just increased that) to be repaired for the same issue and it all needs to be documented and the conclusion after the 6th visit needs to be that the problem still persists. Don't assume making a long list of rattling in the door etc will do it. I never heard of a lemon law which states that after x days of repair...Good luck anyway, wish you would not have that problem in the first place.
^Thanks for the concern, personally I love the Camry I had a 1995 V6 LE which was totaled in 06 and I just wanted another to take its place but this us not what i expected. Actually coming to think of it I liked my old one better than this one. This one is way faster but the craftsmanship of the older ones is untouchable(personal opinion).

Actually coming to think of it I liked my old one better than this one. This one is way faster but the craftsmanship of the older ones is untouchable(personal opinion).
Sorry to hear that - I guess Toyota is not immune to the cost cutting pressure...but, I really like my Gen6.
btw, when you bought your car the dealer should have given you a pamphlet explaining the lemon law in your state. Take that with you everytime you want to document and argue your case.
