Hey everyone, as some of you know ands most of you don't I have been having frequent problems with this car for awhile and lately they have been getting worse. I am starting to get really unhappy with this car and thought of trading it in and getting something else keeps coming into play. I was wondering what actaully constitutes a car as a lemon.
I have brought the car in numerous times for different complaints. The car idles and shakes very badly, they stated that this is normal. It went in twice and everyother time it goes in i mention that and they say they will take a look at it but they never resolve the problem.
But more importantly this car has failed to start for my on 5 different occasions. I have mentioned this and they said it was due it being cold which i took as bs. Now this problem has gotten worse, it happened again today and it was cold 48 deg.F. 1 more thing to add to the starting problem I just got remote start but it, so now im just waiting for them to blame the remote start installer even though this problem has been around way before the install.
I will going back next week, too busy this week with work but I hope to speak to manager or some corporate person and get some answers. Its alot of bs and wasted time on my end.
So if anyone can help me out with explaing the lemon law and if any has had similar problems please let me know what has been done and if your problem has been fixed.
my car came with a toyota brochure that explained the lemon law for every state in the US..

Yes, my one came with all the manuals (but is a separate paper) and the dealer walked me through the lemon law. Too bad, I am not home to look it up for you - I am also in NY. But from what I remember, I believe it was now 4 (or even6?) times that you need to bring the car back to the dealer for the same issue. Also, important that every time the dealer documents to have looked at the same problem and could not fix it. But it does su...if the car does not start...48F is not cold and the car should start anyway at even colder temp.
When you it does not start what does that mean? Does the starter cranks the engine or simply nothing happens? I am asking as I have a similar issue (starter is winding but car does not start) on my RX-8, which are known for that issue and it is caused by flooded spark plugs (problem with engine management under certain conditions, warmstart). Mazda recommends to prevent that by simply replacing the plugs more frequently or clean the plugs (latter is a pain in the bud on the small rotary engine) - RX-8 has some special, expensive plugs (140$ for a set).
It's important for you to know that lemon laws are state specific. So the only feedback on here that you should take to heart is anyone that has dealt with the NY lemon law.
I can tell you that it takes a whole lot of evidence before you can try to enact the lemon law. Usually, a dealer will buy-back the car from you as a trade-in before it gets to that point, because then the car doesn't get reported as a lemon, and then they can resell it to some shmuck as a used vehicle. Totally unethical IMHO, but that's business.

What engine do you have? You know the modern engines have allot of electronic position sensors. The crank shaft sensor may be your problem or another one of the gizmos that make it all go hummmm. Try another dealer and ask before you gop if they would please (PLEASE) find the problem. And suck up a little and say you will never go to the other guy again. That sensor thing could be the bug.

I have the 4cyl engine, I am going to the dealer I bought the car from next week to have them fix my windows which are having problems, they ordered the peiece so when its in for that I will have them check the starting issue again. If nothing changes I will bring it to another toyota dealer, is it still covered or do I have to pay. I mean toyota is toyota is shouldnt matter which dealer.

I will check the manuals and the papers that came with the car. As for not starting my problem started with an extended crank time then usual when I first got the car. Then it turned it to a very long crank and nothing. Today for instance I had to hold the key for almost 10 seconds till the engine turned over. Its sad on a new car with just 2k miles on it that I have had so many problems, I had my gen 4 for almost 7 yr with 56k on it and no problems.
