If you paid for new you deserve new. Take them back. But if it is apparent someone used them for the weekend and didn't like them, and there is no apparent flaw, then is there really a problem? I get you just want to be the one who wears the paper label off the tread. See if they will give you 20 bucks credit or something.

My hope was so high.. expecting excellent of excellent..... only to discovered it has been used.

How much of a wear would a tire consider used? I want it new. Can you tell roughly now many miles was driven from looking at the tread? Or if the tire were abused?
They can just easily say, you're the one who used it.
Ordered it online and no I hadn't install it. Was and still planning to install/mount it Sept 6th. So the tires are still wrapped in original packing. They can verify with their original sticker that they slap on that I hadn't remove it.
Maybe they weren't used, but instead they were hand-rolled along the road during shipping. They could have gotten dirty in the shipper's warehouse, etc. Are you sure they were ever mounted on a wheel?
