What is the rule with tires? What do I do and what do I look for?

I just bought 4 new tires and found out 2 of them have sign of wear. The rubber clearly have sign that it has been driven.

If you paid for new you deserve new. Take them back. But if it is apparent someone used them for the weekend and didn't like them, and there is no apparent flaw, then is there really a problem? I get you just want to be the one who wears the paper label off the tread. See if they will give you 20 bucks credit or something.

Maybe you should take them back to where you got them from.

My hope was so high.. expecting excellent of excellent..... only to discovered it has been used.

Yup, made by TTM77, it broke after first use at the beach.

How much of a wear would a tire consider used? I want it new. Can you tell roughly now many miles was driven from looking at the tread? Or if the tire were abused?

Send/take them back. Most likely the purchaser before you probably returned them for a good reason.

Ordered it online and no I hadn't install it. Was and still planning to install/mount it Sept 6th. So the tires are still wrapped in original packing. They can verify with their original sticker that they slap on that I hadn't remove it.

Maybe they weren't used, but instead they were hand-rolled along the road during shipping. They could have gotten dirty in the shipper's warehouse, etc. Are you sure they were ever mounted on a wheel?
