Get Toyota to come up with a new software fix for the confused throttle response/hesitation.
It is great off the line, but if you back off and are going 25-30mph and then get on it it does not know what to do, major hesitation. and does not down shift.

..and why would you file that with the NHTSB? ...just drive accordingly. Oh, btw, back in the days when all cars had very simple mechanical transmissions (not like today..really mechanical from the stick to the gear box), shifts where much less smooth and people simply dealt with it.
That's not something you file with the NHSTA for.
BTW, since many people do not have this problem with the same software you might actually consider trying to help the transmission learn what you wanna do.
After you back off the gas it obviously has shifted to a higher gear to cruise. So if what you want is for it to shift back down, try lightly tapping (kinda like a mouse click) the gas pedal once then pushing the pedal down to what you want it at.
I haven't driven your car of course, but on my transmission the first tap where I push in slightly then let off tells the transmission that it needs to switch gears. I presume this is because pushing the gas pedal then backing off tells it that you expected a different gear, and at least on my car it'll immediately switch gears for me.
The transmission is a smart transmission that tries to learn what you want, but it's not psychic...your driving style has to actually tell it what you want. So when it chooses a gear other than the one you want you gotta do something or another to tell it to switch gears.
Also, the transmission looks at how fast you push down the pedal as well to figure out which gear you're looking for. So if it's being hesistant you can also try just pushing the pedal down faster, or slower, or whatever. It's much more advanced than the older automatic transmission, so if you're angry at it because you're trying to drive it like some 1970's automatic then it's your fault.
I've honestly lost count of the times where people complain about a Toyota transmission behaving exactly like it's supposed to-stuff I think of as useful features that let me control the gear I want it in other people think of as the transmission being defective. Some people do the double tap thing and then are shocked that the car surges forward since it downshifted for them. Use the software in your brain to control the transmission, jeez.

For example you may pull out into traffic from a side street and have enough room to merge with traffic and match the speed of the flow only "if" the car responds as normal. If it does not the oncomming traffic may not be able to stop in time causing a collision.
This happened several times with my first drive by wire car, the 99 BMW 3 series. Almost got me killed three times but in each case the traffic was able to stop in time.
My 07 v6 Camry does this but only 2 or 3 times a year and so far it has not been in the above situation. I do fear it's going to happen some day and the accident will "look" like my fault and there will be no way for me to prove it was not.

...than adjust your driving style and only merge when you have enough clearance to oncoming traffic including a slower than optimal acceleration. I always do that - even w/o hesitation or other issues.

That's not practical or possible in all cases. For example I don't have a way of knowing how long the hesitation will be, the number of seconds vary. Also, in heavy traffic there may be no time when there is "enough" room to compensate. The bottom line I shouldn't have to do this, I paid for a car that works as advertised (0 to 60 spec) and the car should be just that.. nothing more nothing less.
With the car market like it is now, there are no brands (even Toyota) that can afford to tell customers to just "get used to it". This is not a sellers market.
