Yes there is a difference, usually the aftermarket ones come with insane colors like 10000k, or 8000k........the only OEM color is 4100k!! So these aftermarket colors may turn out green, dark blue, or purple like a black light in a club. And because the higher "K" you go, the less lumens output......the light will seem dull, especially in bad weather. Also, alot of the aftermarket kits are made of cheap bulbs which may burn out in less then a year. I've also heard complaints of bulbs being mismatched in color.
There's no way a cop can prove what is OEM or not considering so many cars come with HID as options.......and cops don't carry around lists of whats OEM or not.
But what cops DO look for are those insane colors I mentioned above........4100k is the only color which falls within the DOT guidlines of "white".....anything else stands out like a sore thumb. The color blue you see on OEM is due to shields and reflectors, and shields can be made on your own headlamp as well with a little effort.
Also cops notice glare......but if you have your bulbs installed correctly and build a shield to go underneath it, you can reduce glare.
You can possibly get by without a shield on some bulb applications like H4, 9006, H7, H9 because they don't use the lower half of the lamp to distribute light. The lower part of the lamp is where the glare comes from because light hits the bottom and reflects upward into the air. 9004 and 9007 applications will definantly need a shield because they use the whole lamp for light distribution

Exactly!!!! These are the ballasts that come with the HID Systems I was advertising:
notice the "DOT" on the sticker.
