well, i got into an accidrent in which the guy from behind me hit me while i was turning left..my whole door is dented, and i dont know what to do...its his fault, be he claimed it was my fault!! n-e ways, i wrote the report, and i wanna know what happens next. are there any tips you can give me so i can get more out of this from the insurace company??its a really bad day for me, so please be helpful...i live in montreal if thats of any use.peace out
The rule of thumb is that if you get rear ended, the person behind is at fault for following too close. However, every case is different (ie. emergency stop that prevented him from stopping quick enough)
How exactly does somebody rear-end you while making a left turn?
Take your car to the most reputable body shop possible. Maybe even a Toyota dealer for the repairs. Don't accept some crappy insurance company referal.

If you've been considering getting a body kit, this is a good opportunity. If they do determine that you're not at fault, ask if they are willing to pay for an aftermkt body kit. If there is any differnce in price, offer to pay the differnce.
Well, i was turning into a street, and he wanted to turn into it also, but he was speeding and the in was raining hard...as i was turning, he wanted to turn also, but he couldnt stop, so he completely bashed my door.Will i get to talk to my insurance company? will i be able to tell them my side of the story..does the fact that i had a witness help in any sense???please enlighten me on all these aspects, i really feel like sh*t.thx for the replies i got, keep em coming
the fact that the weather conditions were poor and you were driving with reasonable care, I don't see how it could be your fault. Witness' are usually very helpful provided you aren't the party at fault. Get your insurance representative to fight the case on your behalf. Don't even settle for 50/50 fault if you did absolutly nothing wrong. You pay crazy premiums as it is. Get full use of them when you need them!
Get them (your insurance co.) to inspect the other parties tires and brakes immediately. Get the witness to file a formal report with the police.
BTW- Document everything. Who you spoke to, their tel#, dates, times etc... When you're ask to recall details in a stressful environment, you'll forget things.

Thank you very much for those replies..One more question. The drawing of the accident was not well done by me (i am nowhere near an artist and i wasnt concentrating on the drawing). It almost makes me look like i am at fault. Do they base everything on the drawing??
im not sure about the drawing man... but if u can prove that he was speeding i think that they automatically place the blame on him... NOT SURE about that either though man :wink:
