So today I picked up an 08 Limited with 20K miles. Went to the finance guy to pay and he wanted to sell me a warranty, OK we worked a deal 8yr 75K for $810 bucks.
Just received a voice mail from the dealership that said, I was not eligible for the warranty he sold to me.
So, do they have to honor it?
Gee what if I put a stop pay on the check and said I made a mistake and didn't want to pay that much, I'll rewrite for 2K less?
Well... if they told you that you could buy a warranty and now one is not available, I'd be negotiating for some free services or something... Not much you can do on the vehicle price at this point. If they want to keep the deal, they should offer up something. It's just good business and it doesn;t cost them much.
A consumer cannot add the warranty once the 3/36 is over, but a Toyota dealer selling the vehicle can.
Not without lieing to TFS. Find out the date of first use (DOFU) on your 2008. That would clarify a lot, i.e. if your date of first use was January 5, 2008 the latest you could purchase a Toyota VSA is January 5, 2011 with less than 36k on the odometer.

Seriously, dealers can add a factory TFS warranty to any used Toyota as long as it's being sold at that time. The year/mileage restrictions are not 3/36 I believe it's 7/100.

Unless things have changed since I've left TFS, a Toyota VSA (Platinum/Gold) that is available to the general consumer must be purchased before the vehicle hits 3yr/36k.
I think you are confusing the Toyota Certified Used Program requirements which is no more than 6yr/85k when it becomes Certified and once it is Certified it is then warrantied with a 1yr/12k Comprehensive warranty and 7 yr/100k (from DOFU) Powertrain warranty.
Check with your manager, an educated salesperson is a better salesperson

You of all should know a Toyota warranty can be applied to vehicles outside of the factory warranty. The used car warranty covers the exact same components as a platinum/gold VSA, it just starts the date the customer drives off the lot instead of from when the vehicle was new.
