Question New gas tank location???

My old gas tank on my 88 pickup is pretty much shot. I have another one off of my parts truck (85 pickup w/ extended bed i think.) The only problem is, the tank on the parts truck wont fit. It's about a foot longer than my old tank, and when I try to put it in where the old tank was, the rear axle is in the way. i started thinking, and I could easily weld mounts and put it behiond the rear axle, side to side instead of front to back. I was just wondering, Is this legal? Also, would this cause me any problems? Should I maybe Weld a cage or something around it? Thanks for any input.

My brother in law had the same problem. He ended up repairing the old tank with a lot of JB-Weld but I don't think that it would be a problem to mount it in the rear of you truck as long as you put a cage around it like you were saying. You are running the risk of a bad fire or explosion if you get rear ended
