Car's been hit

Hey guys,

This evening my dad was coming home from work and after picking up some groceries he was reversing out of his spot towards his left. At the same time another car was backing up towards the drivers left as well and when my dad saw he immediately braked and started honking at the other car (he was about half a cars length out) but the other car just kept reversing and eventually hit our car on the left rear quarter panel. We got the insurance policy and his license plate and we also made the call, but we have a feeling since this is in a parking lot and both cars reversing the insurance company will have a hard time believing this and make it a 50/50 fault.

Here are some pictures

My father managed to pull out the dent, it was significantly worst before but it seems a bit better but still noticeable. How much do you guys think it'll cost to fix this? I live in toronto btw. Thanks for looking!

I dont think it should be 50/50 since you guys already stopped and saw it and honk at it...it should be the others fault for not seeing.

Yeah we shouldn;t be at fault but the problem is that the guy can just claim that we were both reversing and ran into each other. Without any witnesses the insurance company cant verify who is telling the truth and most likely they will make it a 50 50 claim for both parties.

This really blows because we also have a dent on the driver rear door from a hit and run a year or so back and now the car looks horrible with the two dents.

Claiming insurance will probably increase our rates too. This is a pain in the rear really ><

Use a plunger and don't claim it.

The increase in insurance rates are not worth it.

We called the insurance company when this happened and now they say its a 50/50 fault which i really think is unfair. I've explained to them that we've already stopped and started honking but the other party kept on reversing. But they said it doesn't matter as the law say's its a 50 50 fault. We have accident forgiveness but this seems like a waste with such a small accident.

We also had a hit and run about 2 years ago right on the left rear door which still has a dent, so basically 1/4 of the car is dented. I feel bad for the car, i mean we take really good care of it and all this stuff happens to it. The car has about 118, 000 km and we take really good care of the car overall

We have to take the car to the shop on saturday and they will asses the damage.
