There are specific rules that define what constitutes a new car, nothing mentioned is against those rules, as far as I can tell. Like I say, if you want to be sure you are getting an as-new-as-possible car, you're going to need to speak with people and take care of things a certain way. Still if it was a couple hours away, that's a bit more than I'd expect. I'd think anything that far away should have been shipped.
In reality, either way, these things do not really affect the car much at all. Anything under 50-75km on the car when you pick it up is generally considered to be reasonable and acceptable. The car should probably have at least around 10-15km on it when you get it. If you're buying a car that was on the lot for a while, or something from the showroom it may have more. Once the car is "sold," but before it's picked up, there may be other people interested in the same car, but it's the only one they have, so they may show it to others, I would expect that they would probably not let people who aren't staff (or contractors, like transporters) drive the car though. This car would still be considered new, and would be sold as such, in fact it might get traded to another dealer, and even though that dealer never drove the car, customers at the first dealership did.
