ok, so, i got into an accident with a semi-tractor (the big big ones) and it is his fault. Although to my knowledge he didn't get a ticket nor did I. The truck is from Canada, the accident happened in the USA. and when i called his insurance company to file a claim, they transferred me to someone else because the cost of the damage is not high enough (or something like that). So i talked to the guy that I was transferred to, and he said their "computers are down" so he'll have to call me back later that day. Well, the day has passed and he didn't call back. So the next week on Monday, I gave him a call, and there was no answer, so i left a message saying to call me back. The day passed and there was still no call from him.(the insurance guy)
Well, it's been a week and 1/2, and i called him, he finally picked up and said that someone else will be working on my case/file, and told me to send him pictures of the damage to my car and fax him an estimate (almost $3,000 from a local shop). And he told me the person who is investigating my case/file/claim will be calling me in 10 minutes because, quote, "She's on a coffee break." Okay, it's been a day and still no call. I smell something fishy going on around here. Is this a trick insurance companies use? to purposely avoid and try to rid someone like me when it's their customer who was at fault?? Opinions, comments, and concerns please! post away! any tips on what i should do??
hmmm. Wonder how that works. Maybe they aren't sure what to do? as here we have no fault insurance. someone hits you, you call your own insurance company.
Not all provinces have No fault insurance though, I know Ontario for a fact does but not sure about the other ones.

First, it sounds like they are stalling for time, and that could be for various reasons.
Do you have witnesses for the accident? In a worst case scenario he could just say he has never heard of you and make you prove it was him. In just about any accident you should call the cops. Many states have laws that if the estimated value of the damage is above a certain amount, or if personal injury of any kind is involved, you are legally obliged to call the cops. $3000 damage sounds like it would be an automatic call to the cops in most states. I think it's about $1000 here and it doesn't take much to rack up $1000 in damage. Although getting the cops involved does open new issues (I was in a hit and run once and the cops wrote ME a letter asking for proof of MY insurance!) at least it's pretty solid scene evidence.
Let's say he has told his company he hit you and there aren't any questions about fault. etc. They could be stalling just to try to avoid paying you. My car was hit a few years back. Rear ended, no question as to fault, the guy admitted it and told his company. It took many, many phone calls to his company and about a month and a half before they payed up. I think in the end they got tired of me calling twice a day asking for a progress report and getting more insistent about it as time went by. Don't start nasty, but in the end you have to try to bring some presssure. Oh yeah, I also got passed from representative to representative.
Incidentally, I never did tell my insurance company. I figured it had nothing to do with them. I no longer carried collsion insurance on my car so they wouldn't pay me anything even if they other company defaulted. I also didn't want them involved because although they can probably find out about it through other channels, I was also keeping in mind that insurance companies will jack up your rates given ANY excuse. I was hearing on the radio that even if it is clear it is somebody else's fault, if they even hear that you are in an event that may be related to insurance they put you in a different pool. Yeah totally unreasonable, but the bottom line was don't bother reporting small stuff to your company. In your case you may have collision coverage with your company that could apply, and for $3k you might want to use it, but think it through. The one thing is, if your company thinks THEY will have to pay something then they will work on the other company to cough up, but just think about getting them involved.
A damage or repair estimate is typical. Sometimes they have a representative to do it, but a smaller company may not have one near you and instead have you take it to three places for estimate and send them the quotes.

^there was a police report written by a police officer, why are they stalling for time? I also had an accident earlier this year that was also not my fault and their insurance paid me right away! but this one........is like.......trying to avoid me on purpose, that's just wrong, not how insurance companies should act. I just want them to tell me the truth, that's all, and why they're taking so long. I'm sure the trucker has already admitted it was his fault, what more is there?
You might need to find an attorney in Canada. Most places dont like dealing with ppl who are not from that area and are not accustom to their rules and laws.

if they continue to dick around you could goto the candian consulate and ask them what they can do for you, since they know the laws of their land they may be of some help...or they may tell you to "take a hike eh".

all i suggest is that you get the police report, hopefully you got the license plate number and the drivers license number from the driver. and take it to police, or tell YOUR insurance companie to take care of it.
Besides that i feel that this is a stall because it doesnt sound like they are a legit insurance company. they are probably puttin you off so you get fed up and do it yourself, because sometimes bigger companies know that the little guys wont pay a lawyer to come after them

Well so far we all agree that nobody likes to be put off or to have their time wasted. I would start with the police report and at least ask your insurance company what are the normal procedures for this. Normally I would tell you to talk only to the other individuals insurance company but you need to find out how an insurance company would handle this. Even if you dont involve your own ins. company consult with another one and just ask how they would handle this?
i called them just a couple minutes ago and they said they are waiting for a police report, which they say will require at least 20 days to get there. I also asked for the normal guy that was working with me, but they said he was gone for this week and will be back on monday. Does any of this story sound shady to you guys? Is this the right time to let my insurance company handle this? or an attorney?
rice: Why do you pay for insurance ? You pay so they can do all this calling and BS. Thats what they are for. You give them all the info and let them handle it. At least thats the way I have always done it out here in CA.
As for caling the police. ALWAYS call the cops and report an accident. Give them ALL the info. They might want to blow you off but you tell them you want them to listen to your report. First you cover youself just in case the bastard you hit later claims you did a hit and run. Second you cover yourself with the info of the occupants so the accident does not become a clown car of people claiming they are hurt.
