As the title assures, it is a sad tale after all. October is the month, Friday 20th is the day. Nothing seems to be going right today, from machines breaking down at work, to my insurance company not being paid as a direct result of my work not notifying me of my pay on time.
So, having to sacrifice my lunch, I set out from work at around 2:30pm to try and pick up the paychecks before the insurance company attempts a withdrawal of the money. Driving from Brampton to Mississauga took about 20 minutes or so, and I successfully picked up my money from the job agency. Now being almost 3pm and my lunch nearly depleted, I head back to work, but on the way, decide to be more efficient, and while in the area to stop by my automotive parts store on Dixie and Blundell (close to Dixie and Dundas), to pick up a cap and rotor for my newly rebuilt and installed motor (that I have spent months preparing).
As I approach the lights on the Dundas side heading west at Dixie and Dundas, I get the green advancement arrow and follow the row of cars traveling southbound down Dixie. I begin to change lanes left, and find myself behind a Lexus gs300 or 400 at the next set of lights (Dixie and Blundell) waiting to make a left hand (east) turn in the turning lane. The traffic light is still displaying green as the car gets a brake in the traffic flow and proceeds to drive through. I am the next in line to enter the intersection. I do so. The light is still green but the traffic flow is thick, so I enter the intersection and wait. As we all know, there are very little considerate people in the world, so no one is willing to let me pass, even when the light turns amber. So I do what any normal person would do, wait safely until the cars pass.
The light on my end is now red, and I am still waiting in the intersection for my turn to pass through (eastwards). I notice 3 of the 4 rows of cars beginning their safe deceleration as they stop at the designated white line. As I begin to advance through, I notice one vehicle failing to slow, and as I apply my brakes I see a Mr. Rooter van rocket past me with no disregard for the red light signal overhead. The cars to my left and right now have the green light and are starting to advance into the intersection towards me. As I turn my head back to see if it is safe for me to get out of the intersection I see an oriental individual traveling at a rather alarming rate towards my car with complete disregard for the above red light indicator.
The man driving what looked like an 03-05 Dodge Caravan made no attempt to reduce his speed, or to avoid my vehicle. Instead the subject accelerated towards me hoping to somehow fly by my car, even though the light was clearly red, and for quite some time. (It did not just turn red....no, it was red for at least 5 to 6 seconds, because the light on the other side of the road was green, and taking into account the fact that the Mr. Rooter company van also blew the red light, in conjunction with at least a 4 second delay between the light switching, that would make the stop light red for at least 5 to 6 seconds.) There was not even time to throw my car into reverse. I simply braced myself for impact as best I could, and then.......BANG! as if in slow motion I saw the van striking the passenger side of my car close towards the front, wrinkling the hood and sending my car into an almost 360* spin.
All I could do is yell in disbelief. Filled with anger and frustration I somehow got myself out of my car and ran straight towards the man's van. The man of coarse locked to door to prevent access to him. I think that was a good thing because I was absolutely outraged with his complete disregard for road signs, lights and my safety. I mean, how in the world do these people acquire their licenses. and then the police and other civilians blame the young crowd for causing accidents....please, if the government was not full of self indulgent degenerates focused on retaining every penny possible into their own pockets, we would not have privatized licensing offices who sell drivers licenses to irresponsible and utterly senile individuals such as the man who reduced 3 years of my pain staking work into a pile of useless scrap metal before my eyes, and with me in it. None the less, I tried to gather witnesses and ask if anyone has seen what happened. I got nothing but a senile old man who was yelling at me. Disregarding him I attempt to find others. There were a great deal of people but no one was willing to come forth and speak.
I am certain that someone has seen what happened. Anyway, moving on, I finally began to relax, as the tow truck driver arrived at the scene he felt horrible for me and what happened. He saw the individual that was driving the van and was not surprised at the outcome at hand. He also knew without seeing the accident unfold, that that man was responsible. Well, now our fearless peel regional traffic unit officer arrives on scene. Officer Penner, badge # 2473 from the Ontario Traffic Unit tells the hysterical old man to leave immediately as he is nothing but a bother, and proceeds to acquire statements from us. I tell him straight up that this situation looks bad for me, that I am young and I am driving a meticulously prepped track car. However, I am very responsible on the road and with no accidents on my record and with just a simple 15km over ticket I am not about to endanger my safety or that of the car I spent so long building, and I most certainly was not the person running the red light. He hears me out, and then tells the tow truck drivers to lift the cars and move them. To keep the story short, he writes the report and calls me over to the car. Me being unfamiliar with the dealings of an accident, as I am not one to get into them, I listened to what he had to say and thought nothing of his less then adequate report.
He asked me once again to say what has happened without lying, and once again I tell the story as it was. I did not like the fact that police always think that the younger individual is somehow trying to lie their way out of a situation. I told him that I could have simply gathered the information from the offender himself and left, saving me $200 in tow bills. But I stayed, why? Because I thought that the officer would allow justice to be served. He shows me my driving record, and I tell him that yes, I only have one speeding ticket, this is nothing compared to what he shows me next; the oriental individual’s driving record. It is possibly the most horrible and accident filled record I have ever encountered. The officer himself states that, and I do quote "this guy can't drive for shit". I tell the officer, that he does not have to tell me that, because I know, I am the victim of a red light runner. So at the end of it all the officer does not charge anyone.
I am outraged; I ask him why he does not charge the man at fault. He says that he did not witness the accident (well duh, it is not like police wait at every possible corner to witness an accident) and that I am lucky he did not charge me. I am absolutely dumbfounded at the moment regarding his comment towards charging me (for what?), and not thinking clearly at the time, I simply dismiss his remark. As the officer stated, it does not matter if he charged the oriental guy or not, the insurance companies run their own investigations into the matter. That, as I later found out was a gigantic piece of carefully placed misinformation to get me to stop asking questions. The officer leaves and I am forced to fork out $200 for towing out of my plane ticket money. Also, because this occurred on my lunch time, I could not return to work, and was fired on the spot.
I called my work, let them know what happened, and they called me back 10 minutes later only to tell me not to bother coming back.....ever. Wow! This, my friends, is not the worst part. The oriental man, and his wife (oh yes, his wife was in the car too, kind of stupid to run a red light with a passenger in your car, isn't it?), anyway, the oriental man had this to say to my question of what is he going to do to bring my car back to me how it was before he decided to reduce it to a pile of scrap metal? His response was, and I do quote "your car is your problem, my car is mine, call your insurance company they will deal with it" after which he said he does not know how to speak English and that was that. No apology, no asking if I was ok (even though I asked him and made sure he was ok), nothing, just attitude and complete disregard for his actions.
Luckily I decided to tow my car home, otherwise it would be sitting in the impound to this day. After the accident was over with, I asked the tow truck driver to drive me to the bank so I can deposit the insurance money. Luckily I got a very nice tow truck driver and he helped me out a lot, from calming me down at the scene, to driving me around so I can finish my errands. He carefully dropped off what once used to be an 86 Toyota corolla GT-S at my townhouse complex, and I grabbed my other car and headed off to my 2nd job. On the way I noticed the same officer, so I pulled over and talked to him. I thanked him for at least not charging me (although I don't quite know why he would in the first place, and under what grounds) he said that he knew I was bullshitting. I was rather upset, because I have not uttered a word of a lie, but he thought that I was young and was trying to cover something up. I simply said that there is no point of me lying, the accident was over and that I got screwed in the end of it. He asked me to explain the accident, and once more I told him exactly what happened. He felt bad for me of course, but made no attempt to correct it.
Well, after all this was over, I decided to contact the peel regional traffic unit and have a word with the officer who attended the scene. He was not in his office, so I left a message asking him for advice regarding the matter, and that I needed to meet him to talk about the accident report and the improper decisions made, because I would be seeking legal action against the other driver. I of course received no response. Not surprising really, because why should the mighty peel regional police force care about little ol me. This did not happen to them, so why bother right? Wrong! Because it is what the police officers are paid to do, they should investigate the matter further instead of sweeping it under the rug by not returning my calls and answering to my concerns. I realize that not all officers are like this, and I truly feel bad for the fair officers of peel region and others, such as the officers that helped me out at other divisions, and explained to me that the officer that attended the scene has made a huge mistake, and placed my name into the instigator of the accident box. Apparently the two different colors on the accident report sheet matter. I think that this is completely unfair and that the decisions are not justified.
The man who completely ruined 3 years of my work, raised my insurance rates, caused me to lose my job and not be able to buy my plane ticket to Europe gets away scot free, and I get absolutely shafted in the entire process. That is why I am asking, begging even, if anyone has seen the accident, or was driving by when the accident occurred, please, do not be afraid to help me. Every single time I pass by my car in the garage I, can not stand to even look at her. 3 years of hard work, down the drain, and I will not be able to fly to Europe for Christmas to visit my girlfriend in school; all because of this one inconsiderate individual. Please I beg of you; again, if anyone has seen the accident unfold, please contact me. I am pretty much the only person with a flat black 86 corolla on the road. Most people here have seen my car back in the day when it was blue and had interrior, and it would mean the world to me if you saw what happened and could help.
If you can, please, also contact the peel regional police station and let them know what you saw. Just explain where it happened, so they can link it with my case (if they actual have one)

Ever thought about making a formal complaint of the officer? Funny thing though, over here that officer would be in deep shit. They cant just tell the "customer" that he's lying, they would of made a case for the investigator (reports to him), probably both persons would of been called for questioning (doesnt happen in obvious cases, like running a red light) and then it would of gone to court or just a police report and punishment. Very effective... seems like canadas' police suck
so, i read up to about where the other guy didn't get cited....
unfortunately, although the other guy ran a red.... SO did you....
mind you, i've been in accidents, and i've gotten tickets here and there.... but because i can find laws and situations (etc) i tend to fight what tickets i do get.... i'm pretty good at getting them dropped (when it's something i didn't do....) and reduced when I go in and claim fault & give the situation....
however, if you're turning left at an intersection.... at least here in the states it isn't legal to pull out into the intersection, then turn after the light turns yellow/red.... in fact, i NEVER do this myself, and HATE it when others do it (or expect me to)... it's just asking for an accident.
i'm not saying you're literally at fault, but legally you were also in the wrong.... you both probably should have been cited

That's very true, but he's supposed to wait until all cars have gone thru the intersection or stopped moving, in order to finish turning, regardless of the colour of the light. Most cops will let you get away with turning left on a red if you're already waiting after the lines.
That old fucker deserves to get smacked though, he knows it's not his fault one way or another as he can claim he still had a yellow light and you didn't wait for him to turn. I think that's why the cop also said he wasn't giving you a ticket, because usually the person turning left will get the fault on accidents like this, unless of course you have a good witness that can state the light was already red and he kept going.
I understand what happened that almost happened to me a few years back, was out into the intersection waiting to turn light went yellow and of coarse that means speed up to beat the red light well needless to say the other direction went green... luckily i didn't get hit, sorry to hear about the car, things suck...

but my point is... you're not supposed to ENTER the intersection until it's clear for you to turn..... people who pull out into the intersection and waiting aren't there legally.... but it's one of the things that cops give a blind eye to

on a serious note..you could formulate a law suit against the guy that hit you...what he did was destroy private property...same as if he came and vandelized your house...and if you can make some type of records showing how much you worked on the car and what was put in...you could be entitled to charge a fee for the number of hours of work done to the car. thus makeing him pay for the total number of hours of work plus the parts you put in...in the legal system if something is taken from you you have the right to be made "whole" again by the wrong-doer...so if you are serious about getting your car back to how it was before the accident and maybe a little more i'd persue a civil suit against the other driver...
his window would not have stopped me, the woman who rear ended me is still alive because there was NO damage to either of our cars. That little ae92 took a decent blow, I was impressed
She said to me "My ebrake failed" and didn't even get out of the car to look.
As for your job firing you. Call the labour board, they aren't allowed to fire you if it is something like that, as you CANNOT leave the scene of an accident.
Do more my friend, call up the papers. YOu get the shit about the cop fucking you in the news and I gaurntee something will happen. YOu need to voice what has happened
Seems like alot of stupid, insentive drivers out there. I have had to avoid countless situations where people cut me off, see me in the lane but decide an suv is strong enough to just start comming at me. Someone blocked the road with their station wagon, out on a backroad, I was doing 80 km/h at the time and threw the car half into the ditch then pulled it back out, luckily not getting hurt. Because if they wreck my car their car window WILL not save them from me hurting them
thats a big drag dude, got any pictures of the car ? as far as the intersection deal, once the light turns green you can roll into the intersection, once it turns yellow this is "your" time. yellow = clear the intersection.

hey dude I feel ya about 3 weeks ago I think it was. I was on the way to my friends house so older guy coming towards me on decided he couldn’t wait anymore and cut right in front of me to go down another street and in doing this caused me to hit a bolder and flip my car 3 times. well the guy basically got a slap on the wrist and I got slammed with driving over the speed limit (which I was only doing 25 in a 40 cause I had to slow down before that road) and injuring my passenger which was my gf and she was not injured, not paying attention and the lady that had the boulders in front of her house said that I hit her house which also did not happen. The reason I got slammed with all that was because if the cops around here see that you are a younger driver and in a car that’s all worked up, ya know the whole body kit, wing, exhaust, rims all that stuff and you get in an accident or something they immediately think oh its his fault cause he was speeding and being reckless and not paying attention etc.
But yea I feel your pain dude hope everything works out for ya and you get that guy for all he is worth.
Okay I've had over 50 tickets to date... and I've fought every single one of them... in the end only lost 3....Mind you all 3 were outta town tickets aswell... And no it's not that im a bad driver, its once the cops run your plates even once, they tend to keep pulling you over and over again for other stupid reason... I've had tickets for my stereo being to loud when the volume was only at 14... the point is I know how to work the system now.
2nd I've had an accident exactly like yours 3 days after I got my G2 licence.
In Ontario the Law says "when involved in a left turn accident, the vehicle making the left turn is at fault NO MATTER WHAT" - anything objections, take it to court.
In Ontario YOU ARE SUPPOST TO enter the intersection and wait there to make your turn.
The even teach you that in driving school... so who ever says its ILLEGAL, ITS NOT.
You are lucky you didnt get a ticket for the left turn because if you did you insurance would go up 300%. - this is because insurance companies comunicate with each other quickly and if you were charged both insurance companies would agree that you were AT FAULT.
since you didnt get charged they will investigate and probably say its 50/50 FAULT. or maybe even 75% his fault. its a left turn accident SO there is always a brakeup in fault, they cant give him 100% fault.---- THE COP REALLY SAVED YOUR ASS ON THIS ONE... according to the books HE HAS to charge you for improper left turn causing an accident.
some advice,
1.keep a camera in your car with you at all times, take pictures of the accident scene. ALWAYS, MANDITORY...
2.Leave the cop alone, he cant do anything for you, he already saved your ass big big time.
3.LEAVE THE COP ALONE
4. talk to your insurance company, you can even tell them the officer showed you the other drivers record "this is illegal, he's not allowed to show you someone elses record, not even your own".
5. DO NOT SETTLE FOR them writing the car off. even if you didnt have collision coverage you'll still get some money for your car from the insurance because once again 50/50fault.
6. take the car to INSURANCE Recommended shop for estimate. DO NOT TAKE IT ANYWHERE ELSE. if you do it will work against you in the even of cash settlement. insurance approved body shops usually have the highest repair cost bills with excellent quality work. INSURANCE LIKES TO PAY A LOT OF MONEY EVEN THOUGH ITS NOT WORTH IT.
( one of my other cars resently got hit, insurance body shop said $1700 to fix, but i know the car is only worth $1200... I took the car to my friends body shop that said $1100 to fix and he was gonna repaint the whole car for that price aswell)
Insurance didnt want to write off the car even though I told them its not worth it for them to spend 1700 to fix the car and I didnt want to fix the car, I just wanted cash for its actually value of only $1200. They said NO I have to fix it... basically they even said I could get the car fixed for $1700 and once it was fixed I could take it straight to the junkyard if I wanted to but they will not cut me a cheque for $1200 and write the car off.
7. DO NOT SETTLE WITH INSURANCE UNTILL YOU GET WHAT YOU WANT. if you take long enough you WILL GET WHAT YOU WANT. in the end I got $800 from insurance and I got to keep the car aswell.
8. if they want to write off the car tell them you are not going to part with the car, you want to keep it. now you have two choices.
A) they write off car and give you money, you buy back the car from insurance at a cost of roughly 20% of the settlement price. ex/ insurance settlement cheque is $1000, your buy back would be $200.00 --- now you keep the car, and have $800 to fix the car with. ONCE its fixed insurance will want the frame and everything checkd before they insure it again, the car will be BRANDED REBUILT.
B) you fight and fight and fight to keep the car and fight to get CASH with NO OBLIGATIONS TO FIX. settle with cash and car in hand. You want the freedom to take the cash and fix it or take the cash buy another car and swap over all the parts. Either way NO OBLIGATIONS.
Okay I think thats a lot of info for now and Im tired of writing but I hope the above helps.

Yes, in driving school in the states and other places they teach you to pull into the intersection when it is your turn to make the left, and wait for traffic to clear before making the turn. When the light turns yellow, you know people are going to run the yellow, and even the red most of the time. Thats why you wait for traiffc to clear, and then make the turn. Toyotaspeed, I don't know who taught you that it is illegal, but its not, and your method is considerably more dangerous, becasue when you are not in the intersection, and try to make a left on yellow, the time it takes to make the turn is considerably longer and if taken from the crosswalk is an extremely poor angle. They also teach you that you must be in an intersection to make a proper left turn, if you took a turn from the crosswalk on a driver's exam, you would immeadiately fail.
