Question Exhaust question

This weekend I went out and picked up a new cat and a downpipe for my rolla. So I had to cut all of the rusted piping out from underneath. I noticed that a rubber hose ran into my old cat. MY new cat however does not have a spot for the hose to run into. I bolted eberything up and just disconnected the hose and left it where it was (dont worry its not hanging in on the exhaust). I figured it would be ok but my dad is bitching at me whole time about how its not gonna pass emissions. Anyone have an idea what I should do? I'm not planning on drilling my cat to place it in. I was thinkin more of tracing the hose and capping where it started. ANy help is greatly appreciated. Thnaks. -Josh

downpipe as in the pipe that connects the exhaust manifold to the exhaust system.. the piece that has the flex pipe on it..

And what that tube does, is when sufficient vacuum is created in the exhaust system it will draw air down through the air intake to help the cat convert the gases.

I don't know man.. Do they do a visual test or is it tailpipe sniffer? I know up here in PA the emissions are coming back in but for cars '96 and down it's just a visual test and the guy that did the state inspection on my car said that it would pass the visual emissions inspection as well and I don't have that tube connected, although my cat has the line off of it to connect it up.
