carbs

for a 20r, should i use a weber 32/36 or side draft carbs?

A manifold for the side drafts will be hard to find and expensive.
The side drafts are also overkill unless you are building a radical engine (eg for the race track) and like huge fuel bills.
A Weber 32/36 is recommended for a mild street engine.
You will need an adapter plate.
I think www.lcengineering.com sell the adapter plate.

now is the weber 38 banned in all states? and if not then would that be a better option than the 32/36?

I don't know about which states it is legal in (I'm Australian).
I'm also inclined to think it will be too big for your engine.
In Australia we used the Weber 32/36 as the stock carburettor on 4.1 litre 6 cylinder Fords in the mid 1980's (XD Falcon to be exact).
That should supply plenty of fuel for a 2200cc Toyota.
