There are fail-safes that should be present in the cars but are not. Any time a car is in wide open throttle and the brakes are depressed - it should have an emergency fail safe.

Redlands, California – A California law firm has filed a national class action lawsuit against Toyota Motor Corporation on behalf of Toyota and Lexus owners who said they have experienced incidents of sudden unintended acceleration.
The suit claims that several fatal crashes have resulted from the unintended acceleration, including that of a California Highway Patrol officer whose Lexus ES 350 was involved in a crash that also killed the officer’s wife, daughter and brother-in-law. The law firm said that more than 2,000 complaints have been determined from litigation and consumer-reported complaints to the automaker and to the National Highway Traffic Safety Administration (NHTSA).
Last month, Toyota launched a recall asking owners to remove floor mats from the vehicle, which it said were bunching up on the accelerator pedal and causing the acceleration.

Supposedly the problem started when Toyota went to an electronic throttle system. There has never been any evidence that the systems actually failed and caused a full throttle engine condition.
I personally think it is one of the following:
Person steps on the accelerator even though they are certain it is the brake pedal
Floor mat or other object gets in the way of the pedal. May also get between the brake and the gas, so pressing on one will also press on the other
Pedal design makes it too easy for something to catch the bottom (notice the curved bottom area, the pedal should be straight)
Toyota IMO should have put in software a system where if you press the brake when the engine is at full throttle condition for a few seconds, it cuts engine power. No more problem even with bad mats or stupid drivers.
Nice move on your part Toyota. Should of checked quality before hand. Hope Toyota solves this incident quick. Lawsuits against car companies is never good PR.

Why am I not surprised the lawsuit was filed in California? I still think a lot of hype is involved, just like with the Firestone tire issue, but that's just an opinion.
