The really funny aspect of this whole thread is that I have recently come
into possession of an Islamic fundamentalist video which attacks Darwinian
evolution using all the stale old propaganda that we have come to expect
from our own home-grown fundamentalists. They may hate each other, but in
this respect they are on the same side.

You may be jumping to conclusions here.

I accept that with respect to viruses the word species has no meaning. The
other examples given are quite clearly new species, whatever definition you
choose to use.

constitution. In fact he's proud of these behaviors and says he'll continue
them. As far as the counts go, there are probably as many Christians in

I am not oblivious to hidden agendas. There is the whole issue of protecting
Israel, and yes, oil is a big issue, it drives our economy. Establishing a
democracy in Iraq would help with the stability of middle east. Whatever the
agenda may be.

President Bush's post-Sept. 11, 2001, authorization to the Nation*al
Security Agency to carry out electronic surveillance into pri*vate phone
calls and e-mails is consistent with court decisions and with the positions
of the Justice Department under prior presidents.



An identifiable group, al-Qai*da, was responsible for the 9/11 attacks
and believed to be plan*ning future attacks in the Unite4 States. Electronic
surveillance of communications by those who might plausibly be members of,
or in contact with, al-Qaida was probably the only means of ob*taining
information about what they were planning next. No one except the president
and the few officials with access to the NSA program can know how valuable
such surveillance has been in protecting the nation.



In the Supreme Court's 1972 Keith decision that the president does not
have inherent authority to order wiretapping without warrants to combat
domestic threats, the court said explicitly that it was NOT questioning the
president's authority to take such action in response to threats from
ABROAD.



Four federal courts of appeal

FISA's reference to surveil*lance "authorized by statute" is satisfied

those re*sponsible for Sept. 11 from carry*ing out further attacks.



Obtaining intelligence is a necessary and expected component of any
mili*tary or' other use of force to pre*veilt enemy action.



But even if the NSA activity is "electronic surveillance" and the
Sept. 11 resolution is not "statuto*ry authorization" within the mean*ing of
FISA, the act still cannot, in the words of the 2002 Ssupreme Court of
Review decision, "encroach upon the president's constitutional power."



FISA does not anticipate a post-Sept. 11 situation. What was needed
after Sept. 11, according to the president, was surveillance beyond what
could be' authrized under that kind of individualized ,case-by-case
judgment. It is hard to imagine the Supreme Court


second-guessing that presidential judgment.



Should we be afraid of this inherent presidential power? Of course. If
surveillance is used only for the purpose of prevent*ing another Sept. 11
type of attack or a similar threat, the harm of interfering with the privacy
of people in this country is minimal and the benefit is immense. The danger
is that surveillance will not be used solely for that narrow and
extraordinary purpose.



But we cannot eliminate the need for extraordinary action in the kind
of unforeseen circum*stances presented by Sept.ll. I do not believe the
Constitution al*lows Congress to take away from the president the inherent
authori*ty to act in response to a foreign attack. That inherent power is
reason to be careful about who we elect as president, but it is authority we
have needed in the past and, in the light of history, could well need again.
