The easiest way to check the dealer's diagnosis is to move the key fob
farther away from the car and see if the battery drain goes away, although I
doubt if that is the problem. Most state lemon laws cover defects that
affect the use, value, or safety of the vehicle, and I think it is
reasonable to say that a car that does not start is not very useful. The
dealer should be checking for a parasitic draw as well as checking
alternator output.
I would ask the dealer to contact the technical hot line while politely
mentioning that the vehicle has been X times for the same repair without a
satisfactory long-term solution. If they give you the same story, call
Toyota's customer relations line at 1-800-331-4331 or take it to another
dealership if that is not too inconvenient.
