Local man accused of groping pedestrian

GREENFIELD - A Lincoln Street man who has been convicted
multiple times of sex crimes was arraigned Tuesday on a
charge of groping a man who was wearing a skirt on Main Street.

Robert Anthony Martinez, 26, of 86 Lincoln St., has been
charged in the most recent incident with one count of indecent
assault and battery. He pleaded innocent.
At the request of the Superior Court Probation Office, Martinez
is being held on $25,000 cash bail until he can be brought before the
court on Aug. 15 on a violation of probation charge. He was serving five
years probation for a conviction earlier this year.
Martinez is listed by the state as a Level 3 sex offender, the
category considered most likely to commit future sex crimes.
In the incident that led to Tuesday's arraignment, according to police,
the alleged victim and a friend were sitting near Veterans Memorial Mall
on July 23 when they were approached by a man they knew only by the name
"Martinez," who asked for money. He said that he was 'drug sick,'" said
Greenfield detective Laura Gordon.
Gordon said that, after being refused money, Martinez became aggressive
and reached under the garment of the man wearing the skirt, grabbing his
genitals.
Because Martinez is on probation as well as lifetime community parole,
court action against him in this case triggered a violation of probation.
This means that Martinez continues to face the possibility of more than
seven years in prison.

If he is 'most likely' to commit a future sex crime he should be put away
already. And if you're that stupid to do something like that after being let
out then you should be put away for good.

As a level 3 sex offender, he was probably 'committed' to Bridgewater,
where most sex offenders go AFTER their incarceration. They go there to be
evaluated for release. Mass has a "Civil Commitment" ruling; any sex
offender (and I don't know for the life of me WHY this doesn't apply to
murderers...) has to go before a board to be released. There have been
people who have waited up to a year before going before the board, there
are some who are waiting for ANOTHER chance to go before the board...
The board determines, after a series of interviews, tests, etc, as to
whether you are fit to be returned to society. Some pass, some don't.
Obviously, Martinez here got past the board, but they still considered him
a risk, so the SORB (sex offender registry board) leveled him at a level
3, most likely to reoffend. As such, he has to regiter with the SORB every
year, inform police of his residence and any changes to his residence,
give a DNA sample and jump through a bunch of other hoops to stay on the
streets.
He was also on 'permanent probation' until such time (10 years) as he
could prove himself to be lowered to a level 2, also requiring a trip
before the SORB.
Obviosly, Martinez here went under the bus in a number of ways, not the
least of which looking for money for MORE drugs.
But the REAL question here is, why was the OTHER dipshit wearing a SKIRT!

Here in the wonderful "Golden State" the Legislature has been trying
to get the "3 strikes" law overturned.
Their argument is that the third strike should be a violent felony.
Apparently some loser stole a pizza (I guess 2 prior felonies and a
robbery sent him down) from some kids and was jailed under 3 strikes.
If they had their way, the groper above wouldn't be charged unless he
ripped off the idiots cock & balls (must be a violet crime)

Sounds like in this case, the system is working rather well. Guy
offends, gets popped, and goes down. He's on lifetime probation --
thats about as harsh as is constitutionally allowed.

nope. It may suck, but all Americans have rights. Personally I think
they should just cut his testicles off, but thankfully for him I'm not

Besides -- how did he get that way in the first place? How many crimes
were committed by society, his parents, etc etc to make him such a sick
hopeless man?
Rather than having kneejerk emotional reactions to sensationalized
soundbytes, maybe its time to start taking better care of our kids.

I know in some counties in this state that rap-sheets are taller then
the perp.. There have been cases in the county I live in the people
have had three FELONY or more drunk driving offenses and then or 4th
or 5th kill someone and wind up getting a misdemeanor manslaughter
charge with DUI part dropped.
Point I was making about 3 strikes is that if you are stupid enough to
commit crimes that are felonies and you know another crime is going to
nail you. Should society keep giving you chances?

That was right after the three strikes law was passed, back in the late
80's/early 90's. The guy was hungry and went into a pizzaria where they
had pizza by the slice on a pan on the counter. He went in and took a
slice; the owner called the cops and he was put up for life...for a piece
of pizza. I believe, if I remember correctly, his other two crimes were
robberies; a bit more serious than stealing pizza, but this guy should
have NEVER gone up for pizza! Very famous case, I believe the first
conviction under the new law (or one of the very first...)
Before the Gravy Train was cut off (and the job that was paying for me to
go to school came to an abrupt end...) I was Pre-Law...

In this guy's case, he WILL be returned to prison, and WILL have to
undergo another evaluation to avoid Civil Commitment.
Somehow, I DON'T think he's going to make it this time. Perhaps he WANTED
to go to jail forever, because I am POSITIVE he knew the outcome of his

What he's saying is that stealing the pizza resulted in an extreme
sentance (LIFE!) so the Legislature is rethinking the law...and that if
they did what they wanted, he would practically have to KILL someone to be
sent up for the third time...
And yes, with you Liberals, I DO believe that's what they want! However,
for the Republicans, it's Let's send him up BEFORE he does something (I
suppose in the case of a Child Molester you might WANT that, but it's
still wrong...)
