The most obvious solution is to make the losing side of any lawsuit
always pay, but that's not the case in the US.

Up here in Canada, you might find yourself with a countersuit on your hands.
It's not uncommon for litigants to counter with a suit of their OWN, after
being sued.

They have adopted that in Florida. If you bring a dumb-ass suit, and lose,
you pay...your attorneys, courst costs...and your opponent's attorneys!
If you're bringing a suit against a giant like Starbuck's for something
stupid, you had better have deep pockets...

Like that idiot who really *IS* suing them for not honoring a coupon...

If I were the judge (or jury) in that case, I'd tell Starbuck's, "Give him
a free coffee". That's all he lost.

In the UK, it has been known for judges in such suits to reward
the winning plaintiffs with trivial damages, such as 1 penny.

"England" is the place where the Frivolous Lawsuit laws originated. Damn
good idea, if you ask me!
